1. Scope of this Privacy Policy

This Privacy Policy applies to all users and merchants utilizing the TY Rewards platform. It governs data collection, usage, sharing, and storage in compliance with applicable U.S. laws, particularly the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and Florida state privacy regulations.

2. Information We Collect

We collect personal and business information to enable participation in Rewards Programs. For purposes of this Privacy Policy, a “Rewards Program” refers to any promotional or incentive-based program, including but not limited to loyalty programs, campaign-based offers, referral programs, and time-limited promotional rewards that allow Users to redeem or participate in merchant-sponsored benefits.As our platform grows, we may onboard additional types of merchants and expand the scope of our reward programs.

2.1 User Information

Performance Data: Metrics including social section interactions (e.g., views, content engagement, followers, accounts reached).
User Interactions: Data on likes, shares, and content engagement.
Device Data: Automatically reported data at regular intervals from users’ devices.
Billing Information: Collected through our payment processing partner, EBizcharge, and visible within the TY Rewards interface.
Social Media Accounts: Voluntarily provided social media handles.
Use of Cookies: TY Rewards uses cookies and similar tracking technologies to enhance user experience, analyze website traffic, and deliver targeted advertising. These cookies may collect personal information, such as browsing behavior, device identifiers, and interactions with our Services. We may share this data with third-party partners, including advertising and analytics providers, to provide personalized content and ads.

2.2 Merchant Information

To ensure compliance with regulatory requirements, merchants must complete Know Your Business (KYB) verification prior to participation. The data collected includes:

User Credentials: Username, Email Address
Business Profile: Brand Name, Description, Industry Tags, Website
Contact Information: Name, Email, Mobile Phone, Business Phone
Legal Information: Registered Business Name, Employer Identification Number (EIN), Business Address, Business Phone Number
Social Media Accounts: Collected for brand authentication and promotional purposes

KYB data is retained only as long as necessary for compliance and business purposes.

2.3 Third-Party Data Collection

We work with third-party service providers to facilitate transactions, rewards distribution, and merchant disbursements. To enable these processes, we may share necessary details such as the registered business name (for merchants), user identifiers, and contact information with these service providers. Additionally, information may be shared with regulatory authorities to comply with applicable laws.

3. How We Use Your Information

We use the data collected to:

Facilitate reward program participation and merchant transactions.
Enhance user experience and optimize engagement with our platform.
Conduct business operations, including security, analytics, and fraud detection.

4. Data Sharing & Disclosure

TY Rewards does not sell or rent personal information. However, we may share data under the following circumstances:

Service Providers & Payment Processors: EBizcharge and other vendors assisting in secure payment processing.
Legal & Compliance Obligations: If required by law, court order, or regulatory directive.
Business Transfers & Corporate Transactions: In the event of a merger, acquisition, or sale of assets.
With Consent: When explicitly authorized by the user or merchant.

5. Data Retention & Security

We care about the security of your information and implement physical, administrative, and technological safeguards to preserve the integrity and security of data collected through our Service. However, no security system is entirely foolproof, and we cannot guarantee the absolute security of our systems or those of our vendors. In the event of a security breach affecting information under our custody, we will investigate, take appropriate remedial actions, and notify affected individuals in accordance with applicable laws and regulations.

We retain user and merchant data only for as long as necessary to support our business operations and comply with legal obligations. Users may delete their accounts and associated personal data directly through the account settings available in our application.

Please note that certain data, such as records of financial transactions and regulatory compliance information, may be retained even after account deletion when required by law or for fraud prevention and other legitimate business purposes.

6. Data Access & Control

Members have certain rights regarding their personal information under applicable laws, subject to certain exceptions.

Members have the right to request access to the personal information collected about them and how it has been used for business purposes.

Right to Request Deletion

Members have the right to request the deletion of their personal information, subject to legal exceptions. Users can delete their account directly by using the Delete Account option located in the menu of the Profile section of the application. If we determine that certain information must be retained for a legitimate business purpose or legal obligation, we will inform you of the applicable legal exception.

Right to Correct
Members have the right to request that TY Rewards correct any inaccurate or incomplete personal information we have collected or maintain about them, subject to certain exceptions.

Do Not Sell or Share My Data
California residents have the right to opt out of the sale or sharing of personal data. While TY Rewards does not sell or rent personal data, if this changes, members will be provided with a clear opt-out mechanism in compliance with CCPA requirements.

We may request additional verification, such as a government-issued ID, to process your request. You may also designate an authorized agent to act on your behalf, but we will require proof of authorization.

7. Users Outside of the United States

If you are accessing our Services from outside the United States, you acknowledge that your data may be transferred to, stored, and processed in the United States, where privacy laws and data protection regulations may not offer the same level of protection as those in your country of residence. By using our Services, you consent to such transfers in accordance with this Privacy Policy.

8. Minors

We do not intentionally gather information from visitors who are under the age of 13. Our Terms of Service require all users to be at least 18 years old. Minors who are at least 13 years old but are under 18 years old may use a parent or guardian’s account, but only with the supervision of the account holder.

If a child under 13 submits identifiable information to us and we learn that the identifiable information is the information of a child under 13, we will attempt to delete the information as soon as possible.
